What to include in your letter

In order to send a copyright infringement notification to a Scholarius user, please send us a registered letter with acknowledgement of receipt (India) or a letter by ordinary post (other countries) including the following information:

• the notification date;
• if the notifying party is a natural person: indicate the last name, first name(s), occupation, place of residence, nationality, date and place of birth;
• if the notifying party is a legal entity: indicate its legal status, registered office and legal representative;
• the recipient's name and address, or in the case of a legal entity, the company name and registered office;
• a description of the infringing activity and the exact location, particularly the precise URL(s) of the publication(s) that violates your rights
• a statement of the reasons why the content should be removed, including a reference to the applicable legal provisions as well as evidence of the activity;
• a copy of the letter sent to the author or the publisher of the infringing activity or information, requesting termination, removal or modification, or evidence that the author or publisher could not be reached.

It is imperative to sign your letter and to use your company stamp in the case of a legal entity.

If you send your declaration by e-mail, please include a scanned copy of the above-mentioned letter.

Making content unavailable

Upon receipt of your letter, we will make the content that your letter refers to unavailable, insofar as we consider that your notification demonstrates that the content published by the website users is manifestly unlawful.

Other

We would like to stress the fact that this procedure should not be construed as a refusal on our part to enforce your rights, it is simply necessary to formalize our correspondence.

Lastly, ensure that your copyright infringement notification has a sound legal basis and that you are indeed the copyright holder for the works that your notification refers to.

Should you have the slightest doubt as to whether your claim is well-founded, please seek legal counsel prior to sending us your notification. Indeed, making abusive allegations of copyright infringement is subject to prosecution in certain countries.

Furthermore, if you expect that you will need to report a lot of content, we suggest that you contact us directly, by post or e-mail.
